Speed pedelec: what does French law say in 2026?

45 km/h. A bicycle, really?

In the eyes of the law, no: a bike that assists up to 45 km/h is a moped (category L1e-B, EU regulation 168/2013). It’s registered, insured and ridden with a licence — exactly like a scooter.

A moped, not a bicycle
A “standard” e-bike stops assisting at 25 km/h (motor ≤ 250 W): it’s a bicycle, with no formalities. As soon as the assistance goes up to 45 km/h, EU regulation 168/2013 classifies it as L1e-B — a moped (Service-Public.fr).
Registration: certificate and plate
Like a scooter, it must be registered : registration certificate and plate, via theANTS, on presentation of the certificate of conformity (COC). A provisional certificate lets you ride while you wait.
Insurance: “motorised” third-party cover
A third-party insurance policy for motorised two-wheelers is compulsory: bicycle insurance isn’t enough. Generally expect 100 to 150 €/year. Riding without insurance carries a heavy penalty.
Licence and age: AM from 14
At minimum the AM licence (formerly BSR), from age 14. Exempt if you were born before 1988 or hold a car (B) or motorcycle licence.
Helmet, gloves and equipment
The approved motorcycle helmet (ECE 22.05/22.06) is compulsory — a bicycle helmet isn’t enough. CE gloves too. Lights, horn, mirror and reflectors required.
Where to ride: the road
The speed pedelec rides on the road. Cycle tracks and lanes are forbiddento it, unless a municipal by-law allows it. Pavements are forbidden.
Roadworthiness test: every 3 years
Since 15 April 2024, a roadworthiness test has been compulsory, as for mopeds, to be renewed every 3 years. The first deadline depends on the year of registration.
Derestriction: not to be confused
Derestricting an e-bike to exceed 25 km/h makes it illegal. A factory type-approved speed pedelec is perfectly legal — as long as you meet the obligations above.
