GENERAL TERMS AND CONDITIONS OF SALE AND HIRE

This is a courtesy translation. These terms are drawn up in French and governed exclusively by French law: in the event of any discrepancy, the French version (reached with the “Français” link at the top of this page) prevails.
1. PREAMBLE
These general terms and conditions of sale and hire (hereinafter the “Terms”) are entered into between VELO SHOP SARL (hereinafter the “Seller” or the “Hirer”) on the one hand and, on the other, any natural or legal person wishing to purchase products or hire a bicycle through the website www.veloshop-obernai.fr (hereinafter the “Site”), referred to below as the “Buyer”, the “Hirer’s customer” or the “Customer”.
Any order placed on the Site, whether a purchase of a product or a hire, implies that the Customer has read and fully accepted these Terms beforehand.
These Terms cover two separate activities:
- the sale of bicycles, scooters, spare parts and accessories (Part I);
- bicycle hire (Part II).
The provisions of Part III apply to both activities alike.
These Terms apply to the exclusion of all others, in particular those applicable to in-store sales or to other distribution and sales channels. They are governed exclusively by French law and drawn up in French.
2. IDENTIFICATION OF THE SELLER

The Customer confirms that they have the legal capacity required to contract with VELO SHOP SARL.
3. PURPOSE
These Terms set out the contractual relationship between VELO SHOP SARL and the Customer, and the conditions applicable to any purchase or hire made through the Site.
VELO SHOP SARL reserves the right to amend its Terms at any time. Amendments are binding on users of the Site as soon as they are published. The Terms applicable to an order or a hire are those in force on the date the Customer confirms it.
PART I — PROVISIONS APPLICABLE TO ONLINE SALES
This part applies exclusively to purchases of products (bicycles, scooters, parts and accessories) made through the Site.
4. PRODUCT CHARACTERISTICS AND AVAILABILITY
The products offered for sale are those shown in the Site’s online catalogue. The choice and purchase of a product are the sole responsibility of the Buyer.
Products are offered while stocks last. If an item goes out of stock after an order is confirmed, the Buyer will be informed by e-mail or telephone and may be offered:
- a new delivery date, or
- an equivalent replacement product, or
- a refund of the missing item if the above solutions are not possible or not acceptable to them.
If the Buyer accepts none of these, they may request cancellation and refund of the order within 48 working hours.
VELO SHOP SARL cannot be held responsible for stock shortages at its suppliers, which are treated as force majeure.
Photographs, graphics, descriptions and product characteristics are provided as a guide and do not engage the liability of VELO SHOP SARL. Photographs are not contractual, in particular as regards colours. Weights, dimensions and other technical data are indicative, generally for a size M and without pedals, with a tolerance of up to ±10%.
5. PRICES
Prices are shown in euros (€), inclusive of all taxes, at the VAT rate applicable on the day of the order.
VELO SHOP SARL reserves the right to change its prices at any time, without notice. The applicable price is the one in force when the order is confirmed.
The prices shown do not include delivery charges, which are billed in addition on the terms specified when the order is confirmed.
Online sales are open to Buyers resident in mainland France (including Corsica) and in the 24 European Union countries listed in article 8, on the delivery conditions set out in that article. Other destinations are not served online: contact us and we will look at each request individually.
An invoice is issued by the Seller and given to the Customer on delivery or electronically.
6. ORDERS
Any order on the Site is deemed confirmed when the Buyer clicks the final order confirmation button. This constitutes full acceptance of these Terms.
The sale is final only after a confirmation e-mail has been sent to the Buyer and the price has been received in full.
The Buyer undertakes to provide accurate and complete information when ordering. Where information is false or incomplete, VELO SHOP SARL may suspend or cancel the order without notice and without being held responsible for the consequences (inability to deliver, delay and so on).
Once confirmed and accepted by the Seller, the order cannot be modified except with the express agreement of VELO SHOP SARL, and cannot be cancelled except by exercising the right of withdrawal or in a case of force majeure.
The Site is intended for sales to consumers and non-professionals, for their personal needs. The Seller reserves the right to refuse orders for large quantities of the same product (in particular beyond 5 identical items).
7. PAYMENT METHODS
Payment in full is required when the order is placed. Accepted payment methods are bank card, Apple Pay, Google Pay, and instalment payment solutions through our partner Cofidis (3× or 4×, and Cofidis Projexio credit), subject to eligibility and available to customers billed in France.
Payment by bank card is irrevocable, except in cases of fraudulent use. Payments are secured (SSL protocol).
In the event of late payment on an invoice, penalties at the rate of 10% of the amount including tax may be applied, together with a fixed indemnity of €40 for recovery costs. Payments are final only once effectively received by the Seller.
8. DELIVERY
VELO SHOP delivers to mainland France (to Corsica for parts and accessories only) and, for parts and accessories, to 24 European Union countries: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden. Orders may also be collected free of charge from the shop at 26 rue de Sélestat in Obernai.
The available delivery method and its exact price are shown in the basket and repeated before payment. Those figures are the ones that apply; the amounts below are indicative and may change.
Three delivery methods are offered, depending on the nature of the products ordered:
- Parcel shop — Chronopost, for parts, accessories and equipment, parcels up to 20 kg. From €4.90 incl. tax in mainland France, €9.90 incl. tax in Corsica and €5.90 incl. tax in Belgium; also available in Germany, Luxembourg, the Netherlands, Spain, Italy and Portugal. The price depends on parcel weight and country. Time quoted by Chronopost: 2 to 3 working days after dispatch in France, 3 to 6 working days in Europe.
- Home delivery — Chronopost, for the same products, parcels up to 30 kg (20 kg in Belgium). From €12.90 incl. tax in mainland France and from €14.90 incl. tax in the European Union countries served, depending on parcel weight and country. No home delivery to Corsica. Time quoted by Chronopost: next working day before 1 pm in France, 1 to 3 working days in Europe.
- Specialist delivery, by a carrier specialising in cycle transport, for bicycles, electrically assisted bicycles and scooters, in mainland France only, excluding Corsica. The price depends on the delivery department and the box; it is shown in the basket as soon as the postcode is entered, before the order is confirmed: from €32.90 incl. tax for a non-assisted bicycle, €42.90 for an electrically assisted bicycle and €31.90 for a scooter. The transport time quoted by the carrier is 24 to 72 hours after dispatch. Delivery is made by appointment agreed with the carrier by telephone. It is made to the doorstep, at the property boundary: the carrier does not carry goods upstairs, unpack or assemble them. If nobody is there, the parcel may be left in a safe place, with a neighbour or with a caretaker, according to the instructions the Customer has given the carrier.
Free delivery: to a parcel shop, from €150 incl. tax in mainland France and €250 incl. tax in Belgium for parts, accessories and equipment; and for any order from €2,000 incl. tax delivered in mainland France, bicycles, electrically assisted bicycles and scooters included.
Some products cannot be shipped because of their weight, bulk or destination. In that case no delivery method is offered in the basket and the Customer is invited to contact us: a solution and a price are communicated before any order.
Orders are generally dispatched within 2 to 5 working days, depending on product availability and workshop workload (assembly, adjustment, checks). No dispatch takes place on Saturdays, Sundays or public holidays. The transport times above run from dispatch and are additional to this preparation time. They are indicative and not guaranteed, and may be extended by external events (bad weather, carrier overload and so on).
On delivery, the Customer must:
- check the condition of the packaging and of the product;
- check the number of parcels;
- refuse delivery if the packaging is badly damaged;
- set out precise, detailed reservations on the driver’s delivery note (photographs strongly recommended).
Without explicit and precise reservations, no claim for transport damage can be accepted.
In the event of damage or a missing product, contact the Seller within a maximum of 5 days at contact@veloshop-obernai.com or on +33 3 88 04 85 61, quoting the order number, photographs of the parcel and a description of the problem.
A late delivery does not give rise to compensation or to automatic cancellation of the order, except where statutory provisions apply in the event of abnormal delay (beyond 30 days after the indicative date, excluding force majeure).
Where an address is incorrect, where the Customer is absent for appointments set by the carrier, or where delivery is impossible for reasons beyond the Seller’s control, redelivery charges remain payable by the Customer.
9. RETENTION OF TITLE
Title to the products passes to the Customer only after payment of the price in full. Risk passes in accordance with applicable statutory provisions.
10. RIGHT OF WITHDRAWAL (SALES ONLY)
Under the applicable regulations, the Buyer has 14 days from receipt of the products to exercise their right of withdrawal, without giving a reason and without penalty, apart from return shipping costs.
The right of withdrawal may be exercised using the withdrawal form available on the Site or by any other unambiguous written means.
Products must be returned at the Customer’s expense, in their original condition and complete (packaging, accessories, manuals and so on), allowing them to be resold as new, together with the purchase invoice. Damaged, soiled or incomplete products will not be accepted.
Refunds are made within a maximum of 14 days from receipt of the returned products. Returns must be sent as a tracked parcel to: VELO SHOP SARL, 26 rue de Sélestat, 67210 OBERNAI — France.
Important: the right of withdrawal set out in this article does not apply to bicycle hire contracts (see Part II, article 18).
11. WARRANTIES — AFTER-SALES SERVICE
Products sold benefit as of right from the statutory warranty of conformity (articles L217-4 et seq. of the French Consumer Code) and from the statutory warranty against hidden defects (articles 1641 et seq. of the French Civil Code).
To invoke these warranties, the Customer must inform the Seller in writing (letter or e-mail) of the non-conformity or hidden defect, within the statutory time limits, and return the product in the condition in which it was received, with all its elements (accessories, packaging, manual and so on). The Seller will refund, replace or have repaired any product found to be non-compliant or defective.
Excluded from the warranty are: misuse, professional use, negligence, lack of maintenance, normal wear, accidents, force majeure and repairs carried out by a non-approved repairer.
Some products may additionally benefit from a manufacturer’s commercial warranty (motor, battery, display and so on), on the conditions set out in their description or in the manufacturer’s documents.
PART II — PROVISIONS APPLICABLE TO BICYCLE HIRE
This part applies exclusively to contracts for the hire of bicycles and accessories entered into through the Site. In the event of any conflict with other provisions of these Terms, the articles of Part II prevail for hire transactions.
12. HIRE CONDITIONS AND FORMATION OF THE CONTRACT
Bicycle hire is offered to any natural person aged at least 18. Minors may hire when accompanied and represented by a parent or legal guardian, who remains responsible for performance of the contract.
The hire contract is formed by the online selection of collection and return dates and times, followed by payment of the hire amount in full. Confirmation by e-mail constitutes the contract between the Hirer and the customer.
13. HIRE RATES AND PAYMENT
Hire rates are shown on each bicycle’s product page, in euros including all taxes. The price depends on the model, the duration chosen and the options taken (in particular the optional insurance).
Payment in full is required at the time of online booking. Accepted payment methods are bank card, Apple Pay and Google Pay.
The deposit is a card pre-authorisation, separate from the payment for the hire: placed online just before payment when collection is close, requested by e-mail a few days before when it is further away, or taken at the counter on collection for a hire of more than six days or failing that (see article 16).
14. CANCELLATION, CHANGES AND NO-SHOW
The customer may cancel or change their booking by e-mail to veloshop.obernai@gmail.com or by telephone on +33 3 88 04 85 61. The financial terms depend on how far in advance the cancellation is made relative to the scheduled collection time:
- More than 48 hours before collection: cancellation free of charge. Full refund to the original payment method within 5 working days.
- Between 48 and 24 hours before collection: 50% of the hire amount is retained as a cancellation fee, 50% is refunded.
- Less than 24 hours before collection, or no-show: 100% of the hire amount is retained. A no-show means the customer failing to appear at the shop within two hours of the agreed collection time, without a postponement having been agreed with the Hirer.
A change to a booking (dates, bicycle, options) is treated as a cancellation followed by a new booking and is subject to the scale above, unless the Hirer expressly agrees to a simple postponement.
Early return: returning the bicycle before the scheduled date and time gives no right to a refund, not even pro rata.
Force majeure: in the event of severe weather, administrative closure, or any other event of force majeure making the hire impossible, the Hirer may cancel the hire and refunds the amount paid in full. The customer may, on the same conditions, cancel free of charge on production of supporting evidence.
15. COLLECTION, CONDITION REPORT AND RETURN
Collection and return of the bicycle take place exclusively at the shop: VELO SHOP SARL, 26 rue de Sélestat, 67210 OBERNAI, on the days and at the times shown on the Site.
Documents to present at collection:
- valid photographic identification (national identity card, passport or driving licence), presented for checking; the document is returned immediately after checking and photographing. The Hirer does not keep the physical document;
- the bank card used for the booking, for the deposit pre-authorisation;
- the booking confirmation (e-mail or printout).
The Hirer may refuse to hand over the bicycle, without refund, where identification is not compliant, where the customer is manifestly unfit to ride (signs of alcohol consumption, apparent drug use, risky behaviour), or in the event of disrespectful behaviour towards staff.
Joint condition report: a condition report is drawn up at collection and at return. It includes a visual check of the bicycle and its accessories, together with a series of dated photographs kept by the Hirer. The customer is invited to report any anomaly immediately. Collecting the bicycle without reservation constitutes acceptance of its initial condition as documented.
Return: the bicycle must be returned on the date and at the time shown on the booking confirmation, within the shop’s opening hours. Any unreported delay leads to an additional charge of €25 per hour started, up to a full day at the hire rate, taken from the deposit. A delay of more than 24 hours without prior contact may be reported to the authorities as fraudulent use of the vehicle.
On return, a new condition report is drawn up. If the bicycle is returned in the documented initial condition, the card pre-authorisation record is destroyed immediately and no sum is debited under the deposit.
16. DEPOSIT AND SCALE OF CHARGES FOR DAMAGE
The amount of the deposit is stated on the product page before the booking is confirmed. It depends on the bicycle model and on whether the optional insurance is taken (see article 17).
The deposit is not debited at the time of booking. It takes the form of a card pre-authorisation: placed online just before payment when collection is close, requested by e-mail a few days before when it is further away, or taken on site at collection, through the shop’s payment terminal, for a hire of more than six days or failing that. This pre-authorisation entitles the Hirer, in accordance with the general conditions of use of bank cards and with this contract, to debit the payment method thus recorded for amounts due for damage, loss, lateness or charges billed under these Terms.
The pre-authorisation is held until the bicycle is returned, within the applicable interbank authorisation period, and destroyed on return if the bicycle is given back in its initial condition.
Procedure for debiting in the event of damage:
- Finding recorded in the return condition report, documented by dated photographs.
- Written notification to the customer (e-mail or SMS) stating the nature of the damage found and the amount contemplated.
- A period of 48 hours for the customer to make observations or to object.
- Debiting of the deposit at the end of that period if no reasoned objection has been received, or after joint examination.

The amounts above are inclusive of all taxes. They may be adjusted downwards at the Hirer’s discretion where the damage is lesser, or upwards where the actual cost of repair exceeds the flat rate, on production of the supplier’s invoice.
Where the loss exceeds the amount of the deposit, the balance is invoiced separately to the customer and payable immediately. Failing amicable payment, the Hirer reserves the right to start any recovery procedure, including through a bailiff, the corresponding costs remaining payable by the defaulting customer.
17. OPTIONAL INSURANCE
Optional insurance may be taken at the time of booking, at a daily rate shown on the product page. It is taken by selecting the corresponding option before confirming the basket.
Effect on the deposit: taking the insurance reduces the pre-authorisation to €0 for all bicycles, mountain bikes and electric mountain bikes included.
Risks covered:
- accidental, unintentional damage occurring during the hire period, up to a ceiling set at the catalogue value of the bicycle hired;
- theft of the bicycle, subject to a police report being filed within 48 hours of the theft being discovered, and the original receipt being given to the Hirer.
Time limit for reporting a claim: any incident (damage, fall, theft, accident, major mechanical failure) must be reported to the Hirer within a maximum of 24 hours of its occurrence, by telephone on +33 3 88 04 85 61 and then confirmed by e-mail to veloshop.obernai@gmail.com with dated photographs. Late reporting may result in loss of the benefit of the insurance.
Risks excluded from the optional insurance:
- use in competition, organised rides, or intensive sporting use not declared when taking the cover;
- use outside the normal conditions for the model hired (for example a technical downhill trail on a bicycle not intended for mountain biking);
- clear negligence: bicycle left unattended and not locked with the lock provided, battery left outside in bad weather, lending the bicycle to a third party, riding under the influence of alcohol or drugs;
- accessories lost, stolen or damaged (helmet, panniers, lock provided), which remain chargeable to the customer according to the scale in article 16;
- the excess, which remains payable by the customer in the event of a covered claim: 10% of the repair quote excluding VAT for damage, 10% of the bike’s value for theft.
18. NO RIGHT OF WITHDRAWAL FOR HIRE
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal set out in article 10 of these Terms does not apply to services for the hire of goods supplied on a specified date or with a specified frequency. The cancellation conditions specific to hire are set out in article 14.
19. OBLIGATIONS, PROHIBITIONS AND LIABILITY OF THE CUSTOMER
The customer undertakes to:
- use the bicycle for its intended purpose and under the normal conditions of use of the model hired, as stated by the manufacturer and recalled at collection;
- comply with the Highway Code and the regulations applicable to cycles, including the limits specific to electrically assisted bicycles (speed, mandatory equipment, permitted lanes);
- park the bicycle in a safe place and always use the lock provided by the Hirer; overnight parking on the open street is not advised;
- report as soon as possible, and at the latest within 24 hours, any malfunction, incident, accident or claim occurring during the hire, by telephone on +33 3 88 04 85 61;
- return the bicycle in its original condition, clean, complete with its accessories, and with a battery charged enough to allow return checks (for e-bikes).
Wearing a helmet is compulsory for customers under 12 and strongly recommended for everyone else.
Strict prohibitions. The customer is strictly forbidden to:
- ride the bicycle under the influence of alcohol, drugs, or any medication affecting the ability to ride;
- carry out any repair, modification or tinkering on the bicycle themselves (changing parts, dismantling, adding electronic accessories); any unauthorised intervention voids the optional insurance and makes the cost of repair chargeable to the customer;
- use the bicycle to carry loads exceeding the maximum weight authorised by the manufacturer;
- use the bicycle for paid services (delivery, bicycle taxi, lessons), except with the express agreement of the Hirer;
- take part in competitions, races, risky gatherings or stunts.
Liability towards third parties and authorities. The customer is solely responsible, both towards the Hirer and towards third parties, for the consequences of using the bicycle during the hire period, and in particular for any personal injury or property damage they may cause. Any fine, ticket, penalty or compensation due because of an act attributable to the customer during the hire period (traffic offence, obstructive parking, damage to another’s property and so on) remains solely payable by them. If the Hirer is notified in its capacity as owner of the bicycle, the Hirer will be entitled to name the customer to the authority or third party concerned, and to pass on the full amounts claimed, taken from the deposit where not sufficiently covered by insurance.
Liability for the equipment. The customer is responsible for the bicycle and its accessories from collection until it is actually returned. In the event of damage, loss or theft not covered by the insurance, the cost of repair or replacement is taken from the deposit on the conditions and according to the scale set out in article 16.
20. SUB-HIRE AND LENDING
The bicycle is hired exclusively to the person named on the booking confirmation. Any sub-hire, lending or transfer to a third party is strictly forbidden and leads to immediate termination of the contract and to the full value of the bicycle being charged to the customer.
21. GEOGRAPHICAL LIMITS OF USE
Because the Hirer must be able to intervene in the event of an incident and to recover the equipment, use of the bicycle is limited to the Grand Est region (departments 08, 10, 51, 52, 54, 55, 57, 67, 68, 88) and to the immediately neighbouring regions in France (Bourgogne-Franche-Comté, Hauts-de-France), as well as to the cross-border regions of Baden-Württemberg, the Saarland and the Grand Duchy of Luxembourg.
Any trip outside this authorised area requires the prior written agreement of the Hirer, requested at least 48 hours before the planned trip. The Hirer may make its agreement subject to particular conditions (increased deposit, additional insurance, declared itinerary).
Any use of the bicycle outside the authorised area without the Hirer’s prior agreement:
- constitutes a substantial breach of this contract justifying its immediate termination;
- causes the customer to lose the benefit of the optional insurance, if taken;
- engages the full liability of the customer, including for any costs of repatriating the bicycle (travel, van hire, staff time), which may be taken from the deposit up to its amount and billed in addition if necessary.
The hired bicycle may under no circumstances be taken on board a train, an aircraft or any long-distance transport without the express agreement of the Hirer.
PART III — COMMON PROVISIONS
The articles below apply to sales and hire alike.
22. LIABILITY
VELO SHOP SARL is bound only by an obligation of means in the context of online sales and hire. It cannot be held responsible for:
- damage resulting from the use of the internet (data loss, viruses, service interruptions, intrusions and so on);
- non-performance of the contract in the event of stock shortage, unavailability of the product or bicycle, force majeure, or fault of the Customer (incorrect assembly, poor maintenance, inappropriate use and so on).
Where damage is caused by a defective product, any liability lies with the manufacturer, in accordance with the applicable regulations.
23. PROTECTION OF PERSONAL DATA
Personal data collected in connection with orders (sale or hire) is necessary to process them (order management, delivery, invoicing, performance of the hire contract, after-sales service and customer relations).
Categories of data processed specifically for hire:
- identification data: surname, first name, postal address, e-mail, telephone;
- photographic copy of the identity document presented at collection (identity verification);
- details of the bank card used for the deposit pre-authorisation (handled by our payment provider and our card terminal, never stored in our systems);
- photographs of the condition of the bicycle at collection and return (joint condition report).
Legal basis: performance of the hire contract (article 6.1.b GDPR), compliance with legal obligations (article 6.1.c), and the Hirer’s legitimate interest in being able to prove the condition of the equipment in the event of a dispute (article 6.1.f).
Retention period: data relating to the hire, including the copy of the identity document and the condition photographs, is kept for 90 days after the end of the hire, then deleted, unless a dispute is ongoing or a longer legal retention obligation applies (in particular 10 years for accounting records and invoices).
In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, the Customer has rights of access, rectification, erasure, portability, restriction and objection in relation to the processing of their data. These rights may be exercised by e-mail to veloshop.obernai@gmail.com or by post to the registered office address, together with proof of identity. The Customer may also lodge a complaint with the CNIL (www.cnil.fr).
24. COOKIES
Cookies may be placed on the Customer’s device when browsing the Site (computer, tablet, smartphone). They help with navigation, audience measurement and offering relevant content. The Customer may accept, refuse or configure cookies at any time through their browser or the tools provided on the Site.
25. INTELLECTUAL PROPERTY
The content of the Site (text, images, logos, graphics, videos and so on) is the exclusive property of the Seller and its partners, and is protected by French and international intellectual property law. Any reproduction, in whole or in part, of the Site or its content without express authorisation is strictly forbidden and may constitute an offence of counterfeiting.
26. FORCE MAJEURE
The Parties cannot be held responsible for non-performance or delay in performing their obligations resulting from an event of force majeure within the meaning of article 1218 of the French Civil Code, or from exceptional health or climate events beyond their control. Force majeure includes in particular: war, riot, fire, strikes, accidents, inability to obtain supplies, severe weather and so on.
27. ARCHIVING — EVIDENCE
VELO SHOP SARL archives order forms, hire contracts and invoices on a reliable and durable medium, in accordance with the law. The Seller’s computerised records will be regarded by the Parties as evidence of communications, orders, payments and transactions.
28. NO WAIVER — PARTIAL INVALIDITY
The failure of either Party to rely on a breach by the other Party cannot be interpreted as a waiver of that obligation for the future.
If one or more provisions of these Terms are held to be invalid, the other provisions retain their full force and effect.
29. DISPUTES — MEDIATION
In the event of a dispute concerning the application or interpretation of these Terms, the Parties will endeavour to find an amicable solution. Failing that, the dispute will be brought before the competent courts under ordinary law.
Under article L612-1 of the French Consumer Code, the Customer may use a consumer mediator free of charge to seek an amicable resolution of a dispute with the Seller.

A referral to the mediator is admissible only after a written complaint has first been sent to the Seller and has not received a satisfactory answer within two months. The Customer may also use the European online dispute resolution platform.
30. ACCEPTANCE BY THE CUSTOMER
By placing an order or booking a hire on the Site www.veloshop-obernai.fr, a Customer fully adheres to these Terms and is bound to pay. The Customer waives the right to rely on any contradictory document that would not be binding on the Seller.
